1. ACCEPTANCE OF TERMS

By accessing or using Cast by Raven, you confirm that you are at least 13 years of age, that you have read and understood these Terms and Conditions, and that you agree to be bound by them. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
 

2. DESCRIPTION OF SERVICE
 

Cast by Raven is a fly fishing intelligence application designed for Alberta anglers. The App provides the following features:

• AI-powered fishing predictions via Raven Intelligence (powered by Anthropic Claude)

• Live weather and river conditions information

• Interactive map with custom pin dropping and photo attachment

• Personal fishing trip journal with photo capture

• Offline data caching for backcountry use

• Data export functionality

The App is a Backcountry Intelligence product and is intended for personal, non-commercial use.
 

3. AI PREDICTIONS AND DISCLAIMERS
 

3.1 Nature of AI Predictions
Raven Intelligence provides fishing predictions based on weather data, your personal fishing history, map pins, and river conditions. These predictions are generated by artificial intelligence and are intended as general guidance only.
 

3.2 No Guarantee of Accuracy
We make no representations or warranties that the predictions, conditions data, or any other information provided by the App will be accurate, complete, timely, or suitable for any particular purpose. Fishing conditions are inherently unpredictable and subject to rapid change. You should always use your own judgment and local knowledge when making decisions about fishing locations and activities.
 

3.3 Outdoor Activity Liability
IMPORTANT: Fly fishing and backcountry outdoor activities carry inherent risks including but not limited to slipping on wet rocks, fast-moving water, wildlife encounters, adverse weather, and difficult terrain. Cast by Raven and Backcountry Intelligence accept no liability for any injury, death, loss, or damage arising from your use of the App or your decision to fish at any location suggested by or accessed through the App.

You assume all risks associated with outdoor activities. Always check current conditions, obtain required fishing licenses and permits, follow all applicable regulations under the Alberta Wildlife Act and Fisheries Act, and exercise appropriate caution.
 

4. USER CONTENT
 

4.1 Your Data
All journal entries, map pins, photos, and personal data you create within the App are stored locally on your device. In the current version of Cast by Raven (v1.0 Beta), your data is not transmitted to our servers or shared with third parties, except as described in Section 5 (Third Party Services).
 

4.2 Data Ownership
You retain full ownership of all content you create within the App, including journal entries, photos, and map pins. We do not claim any rights over your personal fishing data.
 

4.3 Data Backup Responsibility

As your data is stored locally on your device, you are responsible for backing up your data using the App's export feature. We are not responsible for data loss resulting from device failure, App deletion, or other causes.
 

5. THIRD PARTY SERVICES

Cast by Raven uses the following third-party services to provide its features. By using the App, you acknowledge that your use is also subject to the terms and privacy policies of these services:

• Anthropic Claude API — AI prediction engine. Subject to Anthropic's usage policies at anthropic.com

• Open-Meteo — Weather data provider. Free and open-source weather API.

• MapLibre / MapTiler — Map rendering and tile services. Subject to MapTiler's terms at maptiler.com

• OpenStreetMap Nominatim — Geocoding service for location search. Subject to OpenStreetMap's usage policy.

We are not responsible for the availability, accuracy, or content of these third-party services.
 

6. FISHING LICENSES AND REGULATIONS

Cast by Raven does not provide fishing licenses, permits, or regulatory advice. You are solely responsible for obtaining all required fishing licenses, adhering to all applicable provincial and federal regulations, respecting catch limits, closed seasons, and no-fishing zones, and complying with all requirements under the Alberta Fisheries (Alberta Sportfishing) Regulations and the federal Fisheries Act.

The App may display information about fishing locations including rivers and lakes. Inclusion of a location in the App does not imply permission to fish there or guarantee legal access. Always verify access rights and regulations before fishing any location.
 

7. ACCEPTABLE USE

You agree not to use the App to:

• Violate any applicable laws or regulations

• Interfere with or disrupt the App or its third-party services

• Attempt to reverse engineer, decompile, or extract the source code of the App

• Use the App for any commercial purpose without our prior written consent

• Share API keys or credentials embedded in the App
   

8. INTELLECTUAL PROPERTY

The Cast by Raven name, Backcountry Intelligence brand, skull logo, Raven Intelligence name, and all associated trademarks, graphics, and design elements are the property of Backcountry Intelligence. All rights are reserved.

The App's source code, design, and features are proprietary. You may not copy, reproduce, distribute, or create derivative works based on the App without express written permission.
 

9. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE APP.
 

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BACKCOUNTRY INTELLIGENCE AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
 

11. MODIFICATIONS TO THE APP AND TERMS

We reserve the right to modify or discontinue the App at any time without notice. We may also update these Terms from time to time. We will indicate the effective date of any changes at the top of this document. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.
 

12. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.
